Recent legislation modifies the witnessing and attestation of certain documents. Wills, powers of attorney (general or enduring), and written health directions may now be witnessed validly by audiovisual link. Affidavits may also be validly sworn or affirmed by audiovisual link under the new provisions. The new provisions, which are additional to existing witnessing and attestation arrangements, operate during the COVID-19 restrictions.

The Association has prepared a Guidance Note to assist JPs who may wish to take advantage of these changes.
