Our Guidance Note on Witnessing a Power of Attorney has been updated to clarify the recommended procedural steps particularly relevant to witnessing an Enduring Power of Attorney. The updated procedural steps, although not extensive, will help witnessing JPs to ensure the document meets the requirements of the relevant legislation. An example of a completed Enduring Power of Attorney that follows the Association’s recommended procedural steps has also been included to further guide JPs in their witnessing responsibilities.
We strongly recommend members download the updated Guidance Note and example EPOA and familiarise themselves with the recommended procedures.
The updated Guidance Note (‘Power of Attorney: Part 2 – Witnessing a Power of Attorney’) is available form the Members’ Area under the Professional Development tab.
